Let's say I am running file sharing service, and a user uploads illegal content, who is responsible? What should I do to prevent users from uploading illegal content? set ToS?

First off, I am not an attorney so anything I say is personal opinion and not to be considered legal advice.
The answer to your question probably depends on where you live and the copyright laws there, but check with an attorney. Your profile states you reside in the Netherlands and I have even less knowledge about the laws there than here in the US. Outside of seeking legal counsel, which I would highly encourage you to do, here are a few resources I found online:
