231,268 PointsIt usually depends on the wishes of the original franchise owner.
As I understand it, J. K. Rowling's legal staff (you better believe she's got one) have stated that they won't seek legal recourse against works of non-commercial fanfiction. If this were being commercially published I'm sure it would be a different matter entirely.
Most franchises will probably tolerate something that isn't being distributed for profit, and particularly if its existence serves to promote their proprietary products.
