What about fan fics?

Speaking about Harry Potter, how come people can write something like HPMoR? (I like it even more than the original story btw)

It usually depends on the wishes of the original franchise owner.

As I understand it, J. K. Rowling's legal staff (you better believe she's got one) have stated that they won't seek legal recourse against works of non-commercial fanfiction. If this were being commercially published I'm sure it would be a different matter entirely.

Most franchises will probably tolerate something that isn't being distributed for profit, and particularly if its existence serves to promote their proprietary products.
